LIVE2U Advertising Terms and Conditions apply to all advertising provided by the customer to LIVE2U PTY LTD or any of its subsidiaries (all of which are referred to as ‘LIVE2U).

 

1. Publication of Advertising

1.1 LIVE2U will use its reasonable endeavors to publish display advertising submitted by Customers in the format submitted by the Customer and in accordance with the placement instructions of the Customer including images submitted for publication.  Advertising closes at 5pm 31st of August 2009 andA all advertising space available only until ‘sold out’ due to space restrictions.  

1.2 Customer grants LIVE2U a worldwide, royalty-free, nonexclusive, irrevocable licence to publish, and to sub-licence the publication of, the Advertising in any form and in any medium. LIVE2U may publish print Display Advertising online or vice versa. Customer warrants that it has the right and authority to grant LIVE2U the licence referred to in this clause 1.2

2. Right to Refuse Advertising

2.1 Neither these Terms nor any written or verbal quotation by LIVE2U represent an offer to publish Advertising. A binding contract in relation to a request for Advertising will only be formed between LIVE2U and a Customer when LIVE2U accepts the Advertising in writing and payment has been receipted.

2.2 If a Customer submits Advertising that looks, in LIVE2U’S opinion is in poor taste then LIVE2U reserve the right to decline publication.

3. Right to Vary Format and Placement

3.1 LIVE2U reserves the right;

(a) to vary the placement of Advertising within a particular print title or Internet site; and

(b) to change the format of print Advertising

3.2 LIVE2U will endeavor to notify the Customer of any such changes. However LIVE2U will not be liable for any costs, expenses, losses or damages suffered or incurred by a Customer arising from LIVE2U’s failure to publish Advertising in accordance with a Customer’s request.

3.3 If LIVE2U changes the typesetting configuration for the printing of a publication, LIVE2U reserves the right to shrink or enlarge the size of the Display Advertising by up to 10% without notifying the Customer and without change to the rates for that advertising.

4. Submission of Advertising

4.1 Customer warrants to LIVE2U that the Advertising and the publication by LIVE2U of the Advertising does not breach or infringe:

(a) the Trade Practices Act (Cth), Fair Trading Acts (State) or equivalent legislation;

(b) any copyright, trade mark, moral rights, obligation of confidentiality of other personal or proprietary rights;

(c) any law of defamation, obscenity or contempt of any court, tribunal or royal commission;

(d) State or Commonwealth anti-discrimination legislation;

(e) the Privacy Act;

(f) any financial services law as defined in the Corporations Act 2001; or

(g) any other law or applicable code (including any common law, statute, delegated legislation, rule or ordinance of the Commonwealth, or a State or Territory).

4.2 Customer warrants that in respect of Advertising that contains the name or photographic or pictorial representation of any living person and/or any copy by which any living person can be identified, the Customer has obtained the authority of that person to make use of his/her name or representation or the copy.

4.3 Customer must not submit Display Advertising for publication that contains classified advertising unless otherwise approved by LIVE2U.

4.4 All Advertising material must be submitted electronically in high quality print ready CMYK format and the material must comply with LIVE2U’s specifications. LIVE2U may reject the Advertising material if it is not submitted in accordance with such specifications.

4.5 Display Advertising material submitted electronically to LIVE2U must be lodged by the 21st of

 2009 and include a LIVE2U booking identification number.

4.6 Advertising available until ‘sold out’ It is the Customers responsibility to procure any necessary moral rights consent from authors of work submitted as part of the Advertising.

5. Classified Advertising

5.1 LIVE2U will not publish classified Advertising unless it has been negotiated and is determined appropriate; placement is entirely at the discretion of LIVE2U.

6. Typesetting Display & Design Errors

6.1 LIVE2U does not accept any responsibility for errors in printing of content of display advertising provided by the customer.

Event Advertising (Stickers):

LIVE2U Event Advertising is restricted to live music events and must be held in Australia during 2010.

The Customer must promptly:

(a) check proofs of Advertising, if these are provided to the Customer by LIVE2U; and

(b) notify LIVE2U of any errors in the proofs or any published Advertising.

6.2 We regret that We cannot rectify errors or omissions in the Customers content Advertising after close of advertising.

6.3 We do not represent or warrant that the Advertising will be published or distributed in particular quantities on or by a certain date, nor that it will be continuously available for any period. If a Customer wishes to make a claim on LIVE2U for credit, claim must be made within 14 days of publication.

7. Advertising Cost

7.1 The Customer must pay for Advertising at the rates in LIVE2U’s Current Rates, unless otherwise agreed.  Current Rates may be varied at any time by LIVE2U without notice.

7.2 LIVE2U will provide Customer with a Tax Invoice Receipt or adjustment note (as applicable).

We have a variety of advertising options available including full colour display, premium advertising and event promotion!

 

The LIVE2U ANNUAL CALENDAR will showcase the Top Australian Music Festivals (as voted by the public) and double as an ‘event planner’, all in one publication.  Event Stickers that detail Live Australian Music Events happening in 2010 will be enclosed with the calendar, so purchasers can review the 100’s of different live music event stickers then peel and stick to suit their taste.  Dont miss your opportunity to advertise a 2010 Music Event on one of these stickers!

 

NOT A MUSIC EVENT but targeting a similar demographic, then consider our display advertising packages.  If your product or services target the 18-35 year olds then you could benefit from display advertising.  Unlike other weekly or monthly publications that are discarded after reading our Calendar will be kept for 12 months, providing great exposure of your advertisement during the month(s) you advertise but also being retained as a reference tool during the months you are not showcased.

 

The Wall Calendar will be sold at selected summer music festivals across Australia,  available for purchase via our website (www.live2u.com.au) and other selected other retail outlets. We will also be conducting a national advertising campaign to direct traffic to our website to promote the publication and encourage voting.

 

Want to reduce cost and maximise exposure, then consider affiliation/sponsorship! We can offer premium display/event advertising space to suitable organisations interested in sponsorship arrangements and in return we can offer prime exposure within our calendar and on our website (not available for sale under general advertising sales). Suitable sponsorship might include offers of products/services as we are in the process of compiling a prize pool for our competitions.

 

LIVE2U is seeking expressions of interest for premium advertising space available on the rear cover (A5 half page display advertisement) and A6,A7 & A8 display advertising available on the inside first pages of the calendar. This premium position space may be offered as part of a sponsorship arrangement.
